Please read these Terms and Conditions (“Terms”) carefully before using the Armour Homes website located at armourhomes.au (“Website”) or the ChatGPT-powered assistant available on the Website (“ChatGPT App”). By accessing or using the Website or ChatGPT App, you agree to be bound by these Terms. If you do not agree, please do not use our Website or ChatGPT App.
Website and ChatGPT App Terms
The following seven clauses govern your use of the Armour Homes website and the ChatGPT-powered assistant embedded within it.
1 Website and ChatGPT Services
The Armour Homes Website provides information about the design and construction services offered by Armour Developments WA Pty Ltd, including custom home builds and granny flat construction in Perth, Western Australia. The Website also hosts an AI-powered ChatGPT assistant (“ChatGPT App”) designed to help visitors with general enquiries relating to Armour Homes’ services, including:
- Understanding the custom home and granny flat building process;
- Exploring available home designs and floor plan options;
- Obtaining general information about financing options, grants, and eligibility (e.g. First Home Owner Grant, Keystart loans);
- Getting guidance on the build timeline and construction stages;
- Directing users to the appropriate contact person or team for their enquiry; and
The ChatGPT App is intended as an informational tool only and does not form part of any contractual arrangement between Armour Homes and any person. All building contracts and related agreements are governed by separate written instruments.
2 Eligibility
By using the Website or ChatGPT App, you represent and warrant that:
- You are aged 13 years or older;
- You have the legal capacity to enter into a binding agreement under the laws of Western Australia and the Commonwealth of Australia (or, if you are accessing the Website from outside Australia, under the laws of your jurisdiction); and
- Your use of the Website and ChatGPT App complies with all applicable laws and regulations.
If you are accessing the Website on behalf of a company, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to “you” include that entity.
3 AI-Generated Content Disclaimer
The ChatGPT App generates responses using artificial intelligence. All information, suggestions, estimates, or guidance provided by the ChatGPT App:
- Are informational only and do not constitute a binding quote, contract, financial advice, legal advice, or representation by Armour Developments WA Pty Ltd;
- May not reflect the most current pricing, availability, regulatory requirements, or site-specific conditions;
- Should not be relied upon as the sole basis for any financial, legal, or construction decision; and
- Are subject to change without notice.
Any formal quotation, contract, or commitment from Armour Homes will be provided in writing by an authorised representative of Armour Developments WA Pty Ltd and will supersede anything communicated by the ChatGPT App.
4 Acceptable Use of the ChatGPT App
When using the ChatGPT App, you agree that you will not:
- Submit sensitive personal information such as financial account numbers, tax file numbers, passport details, or health information that is not necessary for your enquiry;
- Use the ChatGPT App for any unlawful purpose, or in a manner that violates any applicable local, state, national, or international law or regulation;
- Provide false, misleading, or fraudulent information;
- Attempt to manipulate, reverse-engineer, or exploit the ChatGPT App or the underlying AI model;
- Use the ChatGPT App to harass, threaten, or harm any person; or
- Use the ChatGPT App in any way that could damage the reputation or operations of Armour Developments WA Pty Ltd.
We reserve the right to restrict or terminate access to the ChatGPT App for any user who breaches these acceptable use requirements.
5 Third-Party Services
The ChatGPT App is powered by the ChatGPT platform operated by OpenAI, L.L.C. (“OpenAI”), a third-party artificial intelligence provider. By using the ChatGPT App, you acknowledge that:
- Your inputs to the ChatGPT App are transmitted to and processed by OpenAI’s systems, subject to OpenAI’s own terms of service and privacy policy (available at openai.com/policies);
- Armour Developments WA Pty Ltd does not control OpenAI’s platform, data processing practices, or service availability; and
- The ChatGPT App may also link to or reference other third-party websites or services. Armour Homes is not responsible for the content, accuracy, or privacy practices of those third-party sites.
We encourage you to read OpenAI’s privacy policy and terms of service before using the ChatGPT App.
6 User Content
When you submit information or messages through the ChatGPT App or any contact form on the Website (“User Content”), you grant Armour Developments WA Pty Ltd a non-exclusive, royalty-free, worldwide licence to use, store, and process that User Content for the following purposes:
- Providing and operating the Website and ChatGPT App;
- Responding to your enquiry or request;
- Improving the performance, accuracy, and relevance of the ChatGPT App and our services; and
- Complying with our legal and regulatory obligations.
This licence does not affect your ownership of any User Content you submit. You represent and warrant that you have all rights necessary to grant this licence and that your User Content does not infringe the rights of any third party. We will handle your User Content in accordance with our Privacy Policy.
7 Limitation of Liability for AI Content
To the maximum extent permitted by law, Armour Developments WA Pty Ltd, its directors, employees, contractors, and agents will not be liable for any loss or damage — including indirect, consequential, special, or incidental loss — arising from:
- Your reliance on any information, response, or suggestion generated by the ChatGPT App;
- Any inaccuracy, incompleteness, or error in AI-generated responses;
- Any interruption, delay, or unavailability of the ChatGPT App or Website; or
- Any unauthorised access to or alteration of your User Content.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. Where the Australian Consumer Law applies, our liability is limited, at our election, to resupplying the relevant service or paying the cost of having the relevant service resupplied.
General Provisions
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Website or ChatGPT App after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
Governing Law and Jurisdiction
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes arising under or in connection with these Terms.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be deemed severed. The remaining provisions will continue in full force and effect.
